Initially appointed by the Main Contractor to review the Employer’s assessment of account under JCT Prime Cost Contract. Later appointed to act as Referring Party Representative following the Employer’s immediate issue of the Final Certificate, which sought payment back from the Contractor to the Employer of £1.1 million.

Pyments prepared pleadings to advance adjudication proceedings preventing conclusively of the Final Certificate and successfully argued the Final Certificate was non-compliant. The adjudicator’s decision wholly aligned with matters of principle and quantum advanced by Pyments, resulting in a payment due to the Contractor from Employer in excess of the amounts previously claimed, there by securing a sum of £1.1 million for the Contractor.
