Jointly appointed by the Main Contractor and Employer’s Agent to independently assess the critical delay impact of a specific Relevant Event. The respective parties provided contemporaneous information and assessments of additional time entitlement. Pyments were instructed to prepare an assessment which aligned with the recommendations of the Society of Construction Law Delay and Disruption Protocol and which was to be sufficiently robust so as to address any comments or questions which may subsequently be presented by a survey or acting on behalf of the Employer.
The independent delay report provided a logical and reasoned additional time entitlement assessment which was accepted by both parties and which allowed the project to continue without further timely, expensive and contentious dispute resolution strategies.
