Pyments made a retrospective delay assessment advising on matters of critical delay and concurrent delay during the initial demolition, substructure and façade retention activities. Pyments liaised with King’s Counsel on key areas of delay and prepared a delay expert report with due cognisance to the Society of Construction Law Delay and Disruption Protocol and which formed a composite part of the Employer’s referral documentation in adjudication. The adjudicator’s decision on multiple delay events aligned with Pyments assessment of EOT; Pyments assessment of critical delay was approximately 17 weeks, the Main Contractor argued entitlement to 32 weeks, and the adjudicator determined EOT entitlement of 19 weeks.
